The Berlin Tenants’ Association acknowledges the complexities around rental laws and tenant rights but does not specifically mention subletting enforcement challenges or solutions.

The main reason for not detecting these practices is the chronic staff shortage in the district offices. Possibilities to detect fraudulent practices include comparing the registration office with the land registry or through targeted on-site inspections.

The Senate is examining whether stricter regulations should be introduced to address the issue of illegal subletting, including a potential general reporting obligation for subletting in social housing. However, no concrete legislative initiative at the federal level is planned at the moment.

Without a general reporting obligation for subletting in social housing, many violations remain undiscovered. Between 2021 and 2023, only a handful of cases were uncovered in the twelve districts. The persistence of illegal subletting is a significant concern, as the number of such practices is estimated to be in the thousands.

The control of illegal subletting remains with the districts, but without uniform guidelines, they proceed differently, leading to many violations persisting. The districts have the option to terminate rental agreements or impose fines for proven violations, but this happens rarely.
